Post-Dated Checks & Pre-Dated Checks
Post-Dated Checks and Pre-Dated Checks are often requested by debt collectors.
Debt collectors have become very resourceful in the way they go about collecting past due
debts. In today's 'information environment', debt collectors have become friendlier and
appear to be more accommodating to people that owe their client money.
In an effort to 'help' the consumer, debt collectors will offer up as an option, that you write a
post-dated or pre-dated check.
This means that if you agree to do
so, you will be sending the collection
agency or creditor a personal check
authorizing them to deposit the
check on an agreed specified future
date.
The danger in doing so puts you at
an even greater disadvantage.
Writing a post-dated or pre-dated
check is something that you should
never agree to do. Never agree to
send a check to a debt collector if
you do not have the money readily
available in your checking account.
First, collection agencies have been
known to deposit these types of checks early regardless of the date written on the check.
This will almost always result in NSF (non-sufficient fund fees), and, if you cannot cover the
amount of the check, possible criminal prosecution, due to the fact that you presented
them with a ‘hot check’ and refuse to make it good.
Second, you have now given the collection agent clear access to your entire checking
account. Collection agencies have been known to draft more than the value of the check, up
to the total amount that is due their client.
If you do not have the total amount due in your account, they could drain all that they can.
Leaving you unable to meet other pressing obligations. Such as rent, utilities, car payment
and food.
Further, you will incur additional fees from your bank, and may cause you to lose your
banking privileges.
Do not give the creditor or debt collector any more leverage than they already have.
